


MoneyVista terms of use
We are MoneyVista Limited ("we", "us", "our"), a company registered in England and Wales under company number 04409600. Our registered office is at 55 Gracechurch Street, London, EC3V 0RL.
These Terms of Use cover your use of:
(i) our website www.MoneyVista.com;
(ii) any material and information we publish on our website;
(iii) any software, applications or services we provide on or through our website; and
(iv) any bulletin boards, discussion groups and features on our website that allow you to give feedback to us or that allow interaction between users.
Please read these terms of use carefully before you use MoneyVista. By using MoneyVista, you accept these terms.
1. WHO SHOULD USE MONEYVISTA AND WHAT IT IS FOR
1.1 MoneyVista is intended only for use by residents of the United Kingdom (excluding the Isle of Man and Channel Islands) who are aged 18 years and above. We do not accept liability for any costs, losses or damages resulting from or related to the use of MoneyVista by anyone living outside the United Kingdom.
1.2 The purpose of MoneyVista is to provide you with an on-line, self-directed financial planning service. The service available will help create purely indicative budgets and forecasts based on the information you provide and assumptions within the website which you can change if you wish.
2. ADVICE - IMPORTANT
Nothing in or on MoneyVista constitutes regulated financial or other professional advice in any way. MoneyVista will help you to understand and manage your finances, but MoneyVista does recommend that you should consult a regulated financial adviser or other professional adviser if you require any financial or other professional advice.
3. REGISTRATION
3.1 You must register with us to save your information with MoneyVista. You may register for free and use MoneyVista for a trial period but you will only be able to access MoneyVista on an ongoing basis if you pay the non-refundable Subscription Fee (see section 9).
3.2 You can register online at www.MoneyVista.com. You must ensure that the information on the registration form is accurate and you must tell us straightaway if any of the information changes.
3.3 We have complete discretion whether or not to accept your application to register with us. We may reject your application without giving a reason.
3.4 If you pay us a Subscription Fee, you will need to provide your credit or debit card details. Your card information and billing information will be stored, managed and kept by card companies or our payment gateway provider. Their privacy policies will apply in relation to your card information and other personal details submitted to them. MoneyVista Limited does not store, manage or keep your credit card or debit card details
4. SECURITY
4.1 You will be able to select a password when you register.
4.2 You should memorise your password and ensure you take all reasonable precautions to prevent it from being obtained by anyone else.
4.3 We will ask you to enter a password hint so that if your account gets locked it can be quickly opened by using our on-line facility.
4.4 If you believe that someone else knows your password or is using your password to access MoneyVista without permission, you must ensure that your password is immediately changed using our on-line facility.
4.5 If you fail to take these steps, we will not be responsible for any loss you suffer as a result.
4.6 You must log out of MoneyVista and close your web browser when you have finished using MoneyVista. If you do not do this, information about you may appear on the screen of the computer when it is next used and we cannot be held responsible for anyone else having access to this information.
5. AVAILABILITY
5.1 We aim to make MoneyVista available 24 hours a day, seven days a week. We do not guarantee that MoneyVista will always be available. MoneyVista may be temporarily unavailable or restricted for routine maintenance or other reasons. If this happens we will try to restore availability as soon as possible.
5.2 We may for security reasons restrict or remove your access to MoneyVista if:
(a) the incorrect password is keyed in on three successive logon attempts;
(b) you or we suspect that an unauthorised person is attempting to access MoneyVista using your password;
(c) for valid operational or security reasons, you or we believe it is necessary and appropriate to do so;
(d) you do not pay the Subscription Fee (as defined in Section 9) after the free trial period expires;
(e) you use MoneyVista for any commercial purpose or for any other use which is not personal use (for example, to advertise services that you could offer); or
(f) you fail to comply with the rules set out in the Acceptable Use Policy.
6. INFORMATION ACCURACY AND DISCLAIMER
6.1 We will take reasonable care to ensure that all the information on MoneyVista that we have provided is accurate, current and complies with relevant laws and regulations of the United Kingdom as at the date of issue.
6.2 We cannot accept any liability or responsibility for any information, opinion, recommendation or material displayed, uploaded or distributed through MoneyVista by you or by any other users. You acknowledge that you will be solely responsible for the consequences if you choose to rely on such information, opinion, recommendation or material.
7. INTELLECTUAL PROPERTY
7.1 We either own or we have the right to use all intellectual property rights in MoneyVista.
7.2 You agree not to remove, alter or obscure any of our proprietary rights (including copyright and trade mark notices) which may be attached to MoneyVista.
7.3 We do not give you any right to use any of our trade names, trademarks, service marks, logos, domain names or other distinctive brand features.
7.4 "MoneyVista" is a trade mark of The Royal London Mutual Insurance Society Limited.
8. NO COMMERCIAL USE
MoneyVista is for personal use only and may not be used for any commercial purposes or other than in accordance with these terms of use.
9. SUBSCRIPTION
9.1 We charge a non-refundable subscription fee for continued access to MoneyVista after the free trial period expires ("Subscription Fee").
9.2 Details of the Subscription Fee are available here. All payments and any applicable taxes must be in Pounds Sterling. Your subscription will begin on the date we receive payment of your Subscription Fee and will continue until you cancel your subscription.
10. CANCELLING YOUR SUBSCRIPTION
10.1 You may cancel your subscription within seven working days following the date on which your subscription begins ("Cancellation Period"). To do this you must login and inform us of your request using the online facility within the Cancellation Period and, once we receive your notice of cancellation, we will send you a confirmatory email and return the Subscription Fee you have paid.
10.2 To cancel your subscription at any other time you must login and inform us of your request using the online facility. We will cancel your subscription within seven working days of receiving your notification.
10.3 The Subscription Fee is non-refundable.
10.4 We may terminate your right to use MoneyVista:
(a) by giving you immediate notice, as outlined in section 10.5, if you commit a material breach of these terms and fail to correct the breach within 30 days of being asked by us to do so; or
(b) by giving you as much advance notice as possible, as outlined in section 11.5, in the event that we have to withdraw MoneyVista for legal, regulatory or other reasons. In these circumstances MoneyVista will refund in full any partial and full months' unused subscriptions to you.
10.5 The notices that either we or you are required to serve on each other under this section must be served by email. Any email will be deemed to be delivered on the day it was sent provided the sender does not receive a non-delivery message.
11. CONTENT YOU GENERATE
11.1 We do not control the messages or material posted on MoneyVista by users ("Posts"). We reserve the right to delete, move or edit any Posts.
11.2 You are solely responsible for any content you submit to MoneyVista. You must comply with any of our applicable Acceptable Use Policy. If you fail to do so, we will terminate your access to MoneyVista.
11.3 By submitting any Posts to MoneyVista you agree to compensate us for all claims, costs and expenses (including legal expenses) arising out of any Posts submitted or published by you that are in breach of this section 12.
12. OUR LIABILITY
12.1 Nothing in these terms of use shall limit or exclude our liability (if any) for;
(a) a breach of any term implied by law as to our title to any goods or services we provide to you;
(b) fraud or fraudulent misrepresentation;
(c) personal injury or death resulting from our negligence; or
(d) our breach of our statutory obligation to provide the services with reasonable skill and care.
12.2 Subject to section 13.1, our liability for losses you suffer as a result of us breaching these terms of use is strictly limited to any losses which are a foreseeable consequence of us breaching these terms of use. Losses are foreseeable where they could be contemplated by you and us at the time you accept these terms of use.
12.3 Subject to section 13.1, we are not responsible for; (a) indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us; or (b) any losses which were not caused by our breach of these terms of sale or any increased losses you suffer as a result of your own breach of these terms of use.
13. YOUR INFORMATION We process information about you in accordance with our Privacy Policy. By using MoneyVista, you consent to such processing and you warrant that all data you provide is accurate.
14. VIRUSES, HACKING AND OTHER OFFENCES
14.1 You must not misuse MoneyVista by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to MoneyVista, the server on which MoneyVista is stored or any server, computer or database connected to MoneyVista. You must not attack MoneyVista via a denial-of-service attack or a distributed denial-of service attack.
14.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use MoneyVista will cease immediately.
14.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of MoneyVista or to your downloading of any material posted on it, or on any website linked to it.
15. DOWNLOADS
We do not guarantee the suitability of any downloads from MoneyVista and accept no liability for any problems with your computer that may arise as a result. You accept that you will be solely responsible for any consequences of downloading any material made available through MoneyVista. If you are not sure about the suitability of any such downloads for your computer, please seek specialist advice before downloading.
16. LINKS
MoneyVista contains links to other sites and resources provided by third parties. These links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
17. EMAILS
17.1 We will treat emails and electronic messages you send us as though they were documents sent to us by post. You agree not to contest the validity or enforceability of an email or electronic message you send us. You also agree not to use the absence of a printed or hand written document as reason not to comply with your obligations under these terms of use.
17.2 If you choose to send emails or electronic messages to us, you accept that there can be no guarantee that we will receive your email or electronic message, or that the content of the email or electronic message will remain private or unaltered during its transmission to us. We will accept no liability for any loss or damage you may suffer as a result of this.
17.3 We reserve the right to monitor the use and content of emails and electronic messages which are sent from and received by us for the purposes of ensuring compliance with our own email policy, and identifying and taking action against unlawful or improper use of, or attacks on, our systems.
17.4 Although we scan all emails and electronic messages for viruses, it is never possible to guarantee that our virus-scanning will be completely free of errors. Accordingly, we do not accept any responsibility for any damage caused by a virus or for any alteration made or caused by anyone else, after we have sent you an email or electronic message. We recommend that you employ reasonable virus detection and protection measures when accessing any emails or electronic messages from us.
18. HOW TO CONTACT US
Login to your MoneyVista account and use the online facility to contact us.
19. COMPLAINTS
We will deal with any complaints in accordance with our Complaints Policy.
20. EVENTS OUTSIDE OUR CONTROL
20.1 We draw your attention to the following:
(a) the internet may be subject to interruption or failure through no fault of ours;
(b) you are responsible for providing and maintaining the communications equipment (including personal computers and modems) to use MoneyVista;
(c) we cannot guarantee that MoneyVista will support all browser types and be fully compatible with your communications equipment; and
(d) you are required to maintain a live email address for receipt of ongoing communications. Please add emails from MoneyVista to your safe list.
21. CHANGES TO THESE TERMS OF USE
21.1 We may revise these terms of use and introduce changes to our services at any time. Such changes may be caused by changes in the cost of providing a service to you, predicted changes in legal or other regulatory requirements affecting us, or any system or product development.
21.2 We will give you three months' notice, via email, of any increase to the cost of the service where the reason for the change is not covered in section 21.1.
21.3 You should check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on MoneyVista. If you continue to use MoneyVista after changes have been made, and provided we have told you about those changes, that will mean you agree to be bound by the amended terms of use.
22. GENERAL
22.1 If we fail at any time to insist upon strict performance of any of your obligations under these terms of use, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms of use, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
22.2 You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these terms of use or use of MoneyVista.
22.3 Nothing in these terms of use shall confer, or is intended to confer, on any person or corporation that is not party to these terms of use any benefit or the right to enforce any term of these terms of use.
22.4 The headings will not form part of these terms of use and will not affect their interpretation.
23. GOVERNING LAW
Relevant United Kingdom law will apply to these terms of use and the relevant courts of the United Kingdom will have exclusive jurisdiction over them.
